The Supreme Court approved the list of items that can be taken on the plane for free
The judicial board for administrative cases of the Supreme Court of the Russian Federation rejected the claim of the aviation company “Victory” to the Ministry of Transport and did not withdraw from the Federal Aviation Rules items that a passenger can freely take on board in excess of the established norm of hand luggage.
The new rules for carrying carry-on baggage on the plane have been in force since November last year. The free carry-on baggage allowance established by the airline cannot be less than 5 kg. The passenger has the right to take with him, for example, a handbag, backpack, men's briefcase, portfolio, bouquet of flowers, cradle for a child, crutches, rollers, outerwear.
“Victory” was going to challenge the rules of transportation of hand luggage, as in their opinion they do not take into account the capacity of the luggage shelves of airliners. The general director of low-cost airline Andrey Kalmykov said that at almost 100% load on Victory flights, passengers can take only the calculated baggage allowance (36*30*27 cm). Above these sizes, nothing else can be placed in the cabin. "Victory" was not going to remove from the list wheelchairs, rollers, walkers, crutches, baby cradles.
Heinrich Padva, the lawyer of “Victory” is sure that the Ministry of Transport illegally invades the sphere of legal regulation of air transportation. He recalls that often with a large amount of hand luggage for passengers who enter the cabin last, there is not enough free space on the shelves.
Another representative of the airline said in court that the bouquets of flowers, according to “Victory”, to carry in the cabin of the aircraft is dangerous, because of their high allergy.
The Ministry of Transport notes that the agency drafted changes to the FAP in terms of hand luggage transportation. “The plaintiff says that the Ministry of Transport goes beyond its authority to establish the concept of ‘over the norm’.” We (the draft changes to the rules — ed.) in order to avoid misunderstanding abandon the concept of “over the norm”, including (the list from paragraph 135 — ed.) in paragraph 133, — said the representative of the Ministry of transport, and noted that “on the shelves there is always a place”.
