When do I need an exit permit for a child?

The weather outside is increasingly depressing, and the sun seems to have decided to leave us until May. It is time to break from the first autumn frosts in the velvet season somewhere south, where you can still stock up on heat for the coming winter.

Thoughts about the upcoming vacation can cloud, perhaps, only routine in the preparation of documents, especially if you decide to go on a trip with the heir. Many moms and dads are concerned about the need to issue a permit for the child to travel abroad.

We will understand in which cases without this document can not do and how to properly issue it.

Today, in accordance with the legislation of the Russian Federation, a child can travel in one of the following ways:

- with both parents;

- together with one of the parents;

accompanied by trusted persons;

- independent travel

Family trip

In the first case, an exit permit is not required. There may be problems if parents have different surnames. In such a situation, you will need to present a marriage certificate certified by a notary.

Traveling with a single parent

There are a few ambiguous points.

The law states that, according to Articles 20 and 21 No. 114-FZ “On the procedure for leaving the Russian Federation and entering the Russian Federation” of August 15, 1996, if a child leaves the country accompanied by one parent, the consent of the second is not required for such departure. However, in practice there are a number of exceptions.

One of them is the written disagreement of a parent with the departure of their children abroad. It is possible to specify the presence of such an application both directly from the second parent and in the migration service engaged in registration and consideration of such applications. In such a situation, it is possible to obtain permission for the child to leave the country only through the court. Complicating the situation is the fact that the initiator of the trip must prove the necessity and undeniable benefit of leaving the child from the country.

Without the consent to travel abroad from the second parent can not do when issuing a Schengen visa, as well as when entering the territory of some countries. You can clarify this information directly at the consulate of the country of interest in advance.

There are situations when the permission to leave the second parent loses its relevance:

The parent raises the child alone (for confirmation, a document from the Zags and a document on the status of a single parent are needed).

In the event of the death of one of the parents (to confirm the relevant certificate).

In the event that one of the parents was deprived of parental rights (to confirm will have to present a court decision).

In a situation where one of the parents is declared missing (for confirmation, you need to submit a court decision, or a certificate from the police about the unsuccessful search).

Travel with an escort

When a young traveler travels abroad under the supervision of a third party, such as a grandmother or aunt, consent from each parent will be required (except in the cases mentioned above). In such a situation, the accompanying person is fully responsible for the condition and health of the small tourist.

Independent travel abroad

According to the letter of the law, a child under 12 years old has no right to leave the country without an adult. However, starting from the age of two, children have the right to travel under the supervision of a carrier company (for example, they can be representatives of an airline). In this case, consent to the departure of the child will be required from both parents (except for the above cases).

So, you understand that the permission to leave the child abroad in your case is still required. Let’s figure out how to make it competently.

The first step is to prepare all the necessary documents, including the text of the permit, for certification by a notary:

- passport of the citizen of the Russian Federation of the parent issuing the permit;

- the birth certificate of the child in the original;

- consent to the departure of the child in writing;

Despite the fact that there is no strictly established form of consent to leave, it makes sense to resort to the services of either the notary himself or the organization engaged in the processing of such documents. This will minimize the risk of refusal of permission due to inconsistencies. If this is not possible, check that the text of the consent contains:

- passport data and the name of the parent giving his consent;

- data from the birth certificate and name of the child;

Passport and accompanying person’s name (if necessary)

Exact dates of entry and exit from the country and the place where the child is going.

In the text of consent, you can also prescribe the duties that fall on the shoulders of the accompanying person.

The second step will be direct confirmation of consent in the notary office. To do this, the parent on whose behalf the permit is issued must personally come to the notary with the established documents.

It should be borne in mind that for the services of a notary, a state duty is charged, or a notarial tariff corresponding to the state duty in the amount of 100 rubles. In addition, it is necessary to pay for consulting services, as well as the production of documents.

And the final, third step will be the measures to legalize the document.

Often a notarized statement must be translated into the language of the country to which the child is sent. The need for this procedure can be clarified at the visa center or at the consulate of the country you are interested in.

You can order such a transfer in organizations specializing in this, providing a direct exit permit certified by a notary and data of the passports of the persons specified in the document.

The translated document must also be certified in the notary office and paid by the state. fee for the certificate of correctness of translation in the amount of 100 rubles per page.

Also, some states need not only a translated document, but also the apostille on it. This information can also be clarified at the country’s consulate or visa center. If there is a need for an apostille, it can be placed in the bodies of the Ministry of Justice. For the service, a state fee of 2,500 rubles is also charged.

Well, it's pretty simple. The main thing is to take care of the issue of permission to leave the child outside the country in advance, then nothing will overshadow your trip. Good trips and quick registration of necessary documents!
