Fines for flight delays could increase ninefold
A member of the State Duma Committee on Transport and Construction Maxim Surayev at a meeting of the Duma Committee on June 18 said that air carriers are waiting for high fines for flight delays.
The new version of the bill recommends that each airline pay a passenger 3% of the cost of the ticket for each hour of delay.
If you start with the fact that the average flight in Russia costs 15 thousand rubles. back and forth, compensation will be 225 rubles per hour.
Currently, a fine is paid for flight delay - 25% of the minimum wage established by federal norms (no more than 50% of the cost of the air ticket). The compensation will be 25 rubles per hour of delay - nine times less than proposed in the new document.
Maxim Surayev noted that the passenger has the right to demand from the carrier reimbursement of the cost of the flight in full, which is provided for by the Montreal Convention, which has been in force in Russia since August 2017. The maximum amount of payment for the delay of departure is 414386 rubles. You can count on such amounts if the passenger proves that he suffered losses due to a failure in the airline’s schedule.
Carriers will not be left without protection. If the company presents evidence that the flight delay occurred due to force majeure circumstances, such as bad weather or due to the elimination of a malfunction of the aircraft that threatened the life and health of passengers, the fine is not necessary.
The Committee on transport and construction decided to recommend the state Duma to adopt the bill in the second reading, taking into account the amendments. The last time this issue was discussed in September 2018.
