Each user, carrying out actions on the use of the portal https://personalguide.ru/ and registration in the personal account, agrees to this User Agreement (hereinafter - the Agreement), with the conditions set out below.

  1. Subject matter of the Agreement.
    1. This Agreement regulates the legal relationship between the administrator (manager) of the portal, then the "Administrator", the Organizer of services (private guide or company) of the tourism sector, with offers posted on the portal, hereinafter the "Organizer" and any user (a person using the information, functionality and services of the portal https://personalguide.ru/), hereinafter the "User".
  2. Basic Concepts.
    1. A personal guide is a portal (information aggregator) of the tourism sector, available at https://personalguide.ru/ (including all levels of the domain) through the full and mobile version, allowing the Organizers to publish ads with a proposal to provide their services, and Users to view these ads, book services and conclude direct transactions with the Organizers, hereinafter - the "Organizer's Services".
    2. Administrator - Limited Liability Company "Partner" (TIN: OGRN, legal address: 620042, Yekaterinburg, Victory St., 16, Office 8), which owns all rights to the aggregator "Personal Guide" and the domain https://personalguide.ru/, and which provides Users and Organizers with services to provide access to information and various services.
    3. Organizer - an individual, self-employed, individual entrepreneur or legal entity who have registered on the portal with the provision of personal data by accepting the terms of the Agreement with the Administrator, and providing or intending to provide services to Users in the field of tourism.
    4. User is a fully capable individual who has reached 18 (eighteen) years of age, or a legal entity using the portal ordering or intending to order tourism services from the Organizer.
    5. Personal account - a unique user account on the portal https://personalguide.ru/, containing software functionality for filling, demonstrating and rendering its services.
    6. Announcement (Offer of the Organizer) - an offer (offer) placed by the Organizer on the portal in electronic form to conclude a Deal for the provision of various services, containing textual and (or) graphic information about the services provided to the Portal Users.
    7. Ordering - the actions of the User aimed at concluding a Transaction, carried out using the portal.
    8. Transaction is a civil contract between the User and the Organizer, containing the terms of service provision.
  3. General provisions.
    1. Within the framework of this agreement, the Administrator provides the User with a simple non-exclusive free license the opportunity to use the portal https://personalguide.ru/, search for Advertisements of the Organizers posted on the portal, register in the User’s personal account, access the User’s personal account, exchange information with the Organizers and book orders for the purchase of various services.
    2. At the request of the User, the Administrator also provides him with additional information services for consulting, technical support of Ordering, moderation of disagreements with the Organizer, etc.
    3. The Administrator is not a person providing a direct service to the User, is not a guide, tour operator, travel agent or seller of tourist services, tourist products within the meaning of Federal Law No. 132-FZ of November 24, 1996 "On the Basics of Tourist Activities in the Russian Federation".
    4. The Organizer, when concluding a transaction with the User, acts on its own behalf. In this regard, all issues related to the presentation of claims by the User regarding the quality, volume and (or) terms of services, as well as issues related to the termination of the Transaction, changes in its terms, cancellation of the reservation and (or) the return of funds paid on it, are governed by the terms of the contract concluded between the User and the Organizer for the provision of services and cannot be addressed to the Administrator.
    5. This Agreement enters into force for the Organizer and the User from the moment of its accession to the terms of the Agreement and is valid for an indefinite period.

4. The agreement shall terminate if:

    1. The Organizer or the User will decide to stop using the Personal Guide portal by sending the appropriate notification to the Administrator (by contacting through the feedback form in the Contacts section on the portal) or by independently deleting the account in the personal account of the portal. ;
    2. The Administrator will decide to terminate the Agreement unilaterally out of court with immediate termination of access and the ability to use the Personal Guide portal and without reimbursement of any costs or losses, unless otherwise provided by applicable law. In particular, the Administrator has the right to make such a decision in case of any one-time violation by the Organizer or the User of the terms of this Agreement, or closure of the portal.
  2. Registration on the portal Personal guide.
    1. To register on the portal, the Organizer and the User indicate their name, surname, e-mail address, telephone number, other necessary information in order to identify and provide him with access to his Personal Account (Account).
    2. One Organizer or User may register only one Account. The User is not entitled to transfer the rights to the Account and provide access to it to third parties. The Organizer and the User are obliged to maintain the confidentiality of their data for entering the Personal Guide portal and inform the Administrator of any cases and attempts of unauthorized access to their Account. All actions by a person authorized with the help of login data are considered to be committed by this Organizer or User and entail liability for this Organizer or User.
    3. The Administrator has the right to request additional documents or information from the Organizer or the User for verification or confirmation of authority, and if they are not submitted, to restrict access to the Account.
    4. The Organizer or the User is obliged to provide only reliable information about himself, not violating the law and the rights of third parties. The user is obliged to update information about himself as necessary.
    5. The Administrator has the right to refuse registration or block or delete the Account of the Organizer or the User without requesting any documents or confirmation of authority, if the Administrator has reasons to believe that the information provided is unreliable.
    6. By posting information about yourself on the Personal Guide portal, the Organizer or the User agrees that such information may be available to third parties using the portal.
    7. The Administrator does not disclose to third parties information about the Organizers or Users that are not publicly available, except for the cases provided for by law (for example, at the request of some state bodies). At the same time, the Administrator cannot be held responsible for third-party illegal actions in relation to information that the Organizers or Users independently placed in open access on the portal.
    8. By registering an Account on the portal, the Personal Guide, the Organizer or the User gives his consent in accordance with paragraph 1 of Article 18 of the Federal Law of 13.03.2006 No. 38-FZ "On Advertising" to receive advertising messages from the Administrator (advertising messages) sent to the contact details of the Organizer or the User (email address, phone number, account of the messenger program) contained in the Account.
    9. By registering an Account on the portal, the Personal Guide, the Organizer or the User unconditionally expresses his consent to the Administrator to be sent to the phone number (via SMS messages) and (or) to his accounts of messengers and social networks (Telegram, VKontakte, WhatsApp and others), e-mail (hereinafter - means of communication) of service and system messages (notifications) necessary for using the portal (confirmation codes for authorization on the site, registration confirmation and any other). The Organizer or the User hereby also confirms that it bears full responsibility for ensuring the confidentiality of the information received by the specified method and undertakes to immediately inform the Administrator of any cases of hacking, loss of access to communication means. Before receiving such a message, the means of communication with the Organizer or the User listed in this paragraph are considered safe for use.
  3. Personal data.
    1. Collection and storage of personal data of the Organizer or the User is carried out in accordance with the Privacy Policy https://www.personalguide.ru/text/confpolicy (hereinafter - the Policy). The Organizer or the User is obliged to read the Policy before using the Personal Guide portal.
    2. The personal data of the Organizer or the User means any personal information that allows to establish the identity of the User, including: surname, name, patronymic, passport data, date of birth, contact phone, email address, postal address, bank account details, registration address (residence).
    3. By agreeing to this Agreement, the Organizer or the User in accordance with the Federal Law of 27.07.2006 No. 152-FZ "On Personal Data", expresses his consent to the Administrator to carry out any action (operation) or set of actions (operations) performed using automation tools or without the use of automation tools, with his personal data (processing of personal data), including the collection, recording, copying, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (providing, access) to third parties, as well as in cases expressly provided by the current legislation of the Russian Federation, with respect for his personal data, his consent, blocking, and confirming his personal data. When processing personal data, the Administrator is not limited in the use of methods of their processing. The Organizer or the User gives his consent to the processing, storage and use of his personal data, including for the following purposes:
  • Registration of the Organizer or User on the Personal Guide portal;
  • implementation of customer support by the technical service of the portal;
  • receiving advertising information by the Organizer or the User.
    1. By agreeing to this Agreement, the Organizer or the User acknowledges and confirms that if it is necessary to provide his personal data in accordance with the requirements of the current legislation of the Russian Federation in order to achieve the above goals to third parties, the Administrator has the right to disclose information about him (including his personal data) to such third parties to the extent necessary to perform the above actions, as well as to provide relevant documents. At the same time, the above-mentioned third parties have the right to process their personal data on the basis of this Consent.
  1. Procedure for registration and cancellation of the order.
    1. For the purposes of placing an Order, the User (subject to the provision of personal data - Section 4 of this Agreement) performs the following actions:
  • selects the available Ads of the Organizers on the portal and makes a request to order the selected services by clicking on the button "Start chat" or "Order". By clicking on the "Start chat" button, the User agrees to the terms of the provision of the selected services (according to the Announcement data) and the procedure for settlements on it; If necessary, before ordering, the User can contact the Organizer to clarify the details by chat or with the Administrator through the feedback form (leaving the phone number for communication), via WhatsApp, Telegram or email;
  • After the Coordination of services by the Organizer and the User, further settlements for the services provided are made directly by agreement between the User and the Organizer.
  • organization of further interaction between the User and the Organizer in terms of processing documents for the Transaction concluded between them lies with the Organizer;
    1. In case of cancellation by the User of the reservation (refusal to perform the contract with the Organizer in respect of the ordered services before it begins, but after making the Payment in full or in part), the amount of payment made by the User shall be returned by the Organizer minus the expenses of the Organizer for preparing the provision of these services made by the Organizer before the cancellation by the User of the reservation (including the costs of paying the Service fee to the Administrator). In case of unilateral refusal of the Organizer from the execution of the contract, the return of the funds paid by the User is carried out by the Organizer in full.
    2. Return of funds to the User is carried out by the Organizer within 10 (ten) working days, except for weekends and holidays, as well as natural or man-made accidents, in which the period of return can reach 60 (sixty) working days.
    3. The rules of return established by this agreement may be changed (supplemented) by the Organizers. Order of services by the User means that the Organizer or the User has read and agrees to the proposed terms of refund in full and without reservations. The Administrator shall not be liable to the User for the inability of the Organizer to return the funds transferred to him on the specified conditions.
  1. Calculation order.
    1. The Administrator provides the Organizers with the entire portal service for the implementation of its activities in the field of tourism for a fee for Transactions received from the Users of the portal in the amount of 15% of the received income.
    2. The organizer for the received orders from the Users independently organizes the possibility of receiving payments for the Transactions concluded with the Organizers both with prepayment of the booking of the ordered services and payment by fact (at the place of receiving the service).
  2. Security in the provision of services
    1. The services carried out and provided by the Organizers in the field of tourism may involve risks to the health of the User. Each Organizer, when concluding a Transaction with the User, independently informs and regulates all issues related to the safe provision of the services offered. The User, deciding to use the services of the Organizers, voluntarily and knowingly assumes these risks. If the User receives services with minor children, he is solely responsible for minors in obtaining the selected services in accordance with applicable law.
    2. Before concluding a transaction for the selected services with the Organizer, the User undertakes to familiarize himself with all the information provided by the Organizer about the procedure for organizing and conducting such a service, the requirements and criteria for its participants, any potential risks to his life and health. The User has the right to contact the Service Organizer for additional explanations on the above issues.
    3. The User is notified and realizes that security in obtaining services in the field of tourism lies with the Organizer as the person providing such services to the User on the basis of the Transaction concluded with him, and the obligation to comply with the security requirements when receiving services lies with the User himself.
  3. Final provisions.

10.1. The Administrator is not a person who places any information on behalf of the Organizers as part of the Advertisements published by them (including photo and video materials (images and audio), and therefore cannot control and guarantee its authenticity, quality, security and legality, as well as compliance with copyright (exclusive) rights when it is placed (published) and is not legally responsible for this.

10.2. The Organizer independently publishes photo and video materials (other copyright objects) as part of the published Ads using the functionality of the Administrator’s portal and independently bears responsibility to the right holders (or their authorized representatives) for violation of copyright (exclusive) rights in the event of posting these materials without legal grounds and (or) permissions of the authors. In the relations under consideration, the Administrator acts exclusively as an information intermediary, i.e. a person providing the opportunity to place material or information necessary for its receipt using the Internet information and telecommunication network (Article 1253.1 of the Civil Code of the Russian Federation).

10.3. By sending to the Administrator (both during the validity of this agreement and after its termination) any photo and (or) video materials (images and audio) created by the User during the period of receiving services purchased with the help of this portal (hereinafter - photo and video materials), through e-mail, instant messengers, accounts in social networks, publication of feedback on the Personal Guide portal, etc., the User thereby grants the Administrator the rights to use (including publication, bringing to the public, reproduction, editing, modification of the work, including in the Internet content, and other contents, including those of the author's, and other contents, including the contents. The Administrator also has the right to transfer these photo and video images to third parties (contractors, subcontractors, contractors, contractors, etc.) for purposes at its discretion (including for the fulfillment of the Administrator's instructions related to the activities of the portal (placement, distribution of advertising, promotion of tourist products, etc.) (simple non-exclusive license).

    1. The Administrator reserves the right to amend these Agreements at any time. The Agreement in the new edition begins to operate and becomes binding for all Users from the moment of its publication on the portal: https://www.personalguide.ru
