Day of Prosecutor’s Office of Ukraine

Description:

Day of the Prosecutor's Office
Taking into account the role of the Prosecutor’s Office of Ukraine in strengthening the rule of law, protecting human rights and citizens, as well as the contribution of prosecutors to the formation of Ukraine as a state of law, the Decree of the President of Ukraine dated 02.11.2000 established a professional holiday – “Day of Prosecutor’s Office Workers” – December 1.

The formation of the legal system, and with it the definition of the functions of the Prosecutor’s office on the territory of modern Ukraine began in ancient times.

In 1578, at the Sejm of the Commonwealth, the Lutsk Tribunal was formed - the highest court of Ukraine. The following year, in 1579, the Ukrainian Tribunal was formed in Baturin, which consisted of seven departments. Deputies of the tribunal annually elected a prosecutor (institutor), who oversaw the procedure for submitting claims to the court.

The position of prosecutor remained in Ukraine in the XVII century. In the Ukrainian Tribunal, together with the hetman and other senior ranks, the prosecutor also sat.

In 1722, Peter I established a state body to supervise compliance with the lawful activities of central and local government bodies. The Imperial Prosecutor’s Office, which included the prosecutor’s office of Ukraine, existed until October 1917.

After October 1917, a new stage of the creation of the state and national self-determination of the people of Ukraine began, the stage of obtaining sovereignty. In the Ukrainian People’s Republic (UNR) in December 1917, the Procuratorate was founded, and the following month the Central Council adopted the Law “On the establishment of prosecutorial supervision in Ukraine”.

Since the proclamation of Ukraine as a sovereign and independent state, a new stage in the development of the prosecutor’s office has begun. After the adoption and enactment of the Law of Ukraine “On the Prosecutor’s Office” and a number of other normative acts from December 1, 1991, the legal basis for the organization and activities of the prosecutor’s office of independent Ukraine was created.

In accordance with the provisions of the Constitution of Ukraine, the functions of the prosecutor’s office are primarily those of forming a rule of law state.
