Day of the Prosecutor’s Office of Armenia

Description:

Prosecutor's Office of Armenia
In Armenia, the prosecutorial service began to operate on December 6, 1918, when the Council of the First Republic of Armenia adopted the Law “On the Application of the Laws of the Former Russian Empire in the Territory of Armenia”. This law, in particular, determined that the laws of the former Russian Empire are temporarily valid on the territory of the Republic of Armenia, with additions and changes to the Provisional Government, the Transcaucasian Commissariat, the Seimas and the Council of Armenia. On the same day, the Council of Armenia also adopted a law on the application of the judicial system of the Russian Empire. The prosecutor's office operated under the judicial system.

In Armenia, the prosecutor’s office, as a separate unit, was first organized after the establishment of the Soviet system. Following the example of Soviet Russia, the establishment of a unified legality and the organization of the fight against crime were entrusted to the Prosecutor’s Office of the ASSR, which was established on July 22, 1922. However, as a separate entity, it had a very short life. In December 1922, with the formation of the Soviet Union, among other allied state bodies, the Prosecutor's Office of the Supreme Court of the USSR was also founded, and the Prosecutor's Office of the ASSR became subordinate to the division of this body in Soviet Armenia.

Adopted in 1937. The Constitution of Soviet Armenia significantly increased the role and importance of prosecutorial supervision, specified the structure of the prosecutor's office as a single centralized system, which operated at the head of the Prosecutor of the USSR. The Constitution of the ASSR stipulated that supreme supervision over the correct application of laws on the territory of the ASSR by institutions subordinate to the People's Commissariats of the ASSR, as well as individual officials and citizens, is exercised both directly by the Prosecutor of the USSR and by the Prosecutor of the ASSR.

On September 21, 1991, having proclaimed independence, the Supreme Council of the Third Republic of Armenia announced that the former legislative and other acts will be valid in the country within the limits that do not contradict the ideals of the Declaration of Independence. The USSR Law “On the Prosecutor’s Office” was also included among the acts that did not contradict the principles, and the prosecutorial bodies of the independent Republic of Armenia were guided by this law in their activities before the adoption of the new law.

One of the first steps towards the creation of national legislation regulating the activities of the Prosecutor’s Office was the creation of the Military Prosecutor’s Office as a separate unit on October 5, 1995.

On July 5, 1995, the first Constitution of the Republic of Armenia was adopted, Article 103 of which defines the functions and tasks of the Prosecutor’s Office. The National Prosecution Act was enacted on 1 July 1998 and came into force on 12 January 1999. In early 1999, according to the Law “On the Prosecutor’s Office”, new structural units of the Prosecutor’s Office of Armenia were formed: The General Prosecutor’s Office with its departments and departments, the prosecutor’s office of the regions, the city of Yerevan, the communities of the city of Yerevan and the military prosecutor’s office of the garrisons.

By the decision of the Government of Armenia dated March 7, No. 207-N, July 1 was declared the Day of the Prosecutor’s Office.
