Tourists 'born second time' receive money from tour operators

The first refusals of tours began to come from travelers who were flying on the flight of the airliner A321 a/k “Ural Airlines”, which made an emergency landing in the field on Thursday morning.

Refusals are also for objective reasons - for example, a tour cancels a family with an injured child. Tour operators believe that on the emergency board of the total number of passengers could be up to 50% of organized tourists.

Experts of the tour market say that the money refused to continue the tour will be returned in full, as the situation is clear to everyone force majeure. An agreement has been reached with the hotels.

On August 15, he made an emergency landing on a corn field in the suburbs of the Ural Airlines liner, which flew to the Crimea on a Moscow-Simferopol flight from Zhukovsky airport. There were 233 people on board.

According to the latest information, on takeoff in the engines of the liner got a flock of birds, and one of the engines caught fire. Due to the dangerous situation, the crew decided to make an emergency landing on the nearest flat field, and sat on a corn field. Reportedly, the plane “ploughed” on the belly of almost the entire field without catching fire. No casualties, but 74 people were injured (according to the latest information).

Aviation authorities and the Investigative Committee are investigating the cause of the incident.

The Airbus A-321 of Ural Airlines (flight U6 178 Zhukovsky – Simferopol) and the liability of the air carrier are insured in the insurance company Alpha Insurance. Payments will be made according to the law - the circumstances of the incident are clarified.

Among the passengers of the aircraft, about half are customers of tour operators. “We had three tourists on board, a family with a child of eight. The child received a slight concussion, he was taken to the hospital, where he was examined. It is clear that after the shock experienced, the tourists decided not to fly anywhere, and we will make them a full return for the tour itself tomorrow, said Sergey Romashkin, CEO of the tour operator Dolphin.

According to the interlocutor, in a situation of force majeure with a return of funds, tour operators are meeting, hotels are in solidarity with them.

According to the expert, organized tourists on the flight could be a lot – on these routes to the Crimea organized tourists make up to 50% of the total capacity. Travel agencies report that the flight was part of their tourists who are ready to apply for a refund.

From a legal point of view, the situation looks like this. “Refunds are the prerogative of tour operators. Travel agents, like tourists, have the right to contact tour operators and wait for a decision. If there is a refusal to return money, they can appeal the refusal through the court, says Alexander Bayborodin, head of the legal company Lawyers for Tourism: Bayborodin and Partners.

Market participants plan to be loyal to the victims: “It is a sin in such a situation to pin something, people are still born a second time. I think that no one will offend tourists with money in such a situation, said Sergey Romashkin.
